2. The petitioner seeks bail in connection with Hathauri P.S. Case No. 78 of 2023 registered for the offence punishable under Sections 399, 402 and 414 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.
3. As per prosecution case, the petitioner was one of the members of a group who were planning to commit loot.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and the entire allegations levelled against the petitioner is false. Petitioner is a person of clean antecedent and he is in custody since 17.04.2023.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, the period of custody undergone by the petitioner as also the fact he has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 5th Addl. Sessions Judge, Muzaffarpur, in connection with Hathauri P.S. Case No. 78 of 2023, subject to a condition that:- (i) The petitioner will also mark attendance in Mithanpura Police Station on the first and third Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of his bail bonds.
