JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 20.12.2015 in a case registered for the offences punishable under sections 399, 402, 414 of the IPC, under Section 25(1-B) A, 26 of the Arms Act and under Section 22/ 22 of N.D.P.S. Act. On the information that the miscreants are preparing to commit dacoity, raid was laid. From the other accused persons arms, ammunitions and other articles were recovered but from the possession of the petitioner 2 1⁄2 Kg. Ganjwa was recovered. It is submitted by learned counsel for the petitioner that recovery of contraband is between small and commercial quantity. Though, the petitioner is accused in two other cases from before but investigation in Bidupur P.S. case No. 207 of 2015 has already

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge- In-Charge, NDPS Case, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 525 of 2015.

The learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner gets involved in similar offence or defaults without any reasonable cause on three consecutive occasions.
