Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-307, 379 & other minor sections of the Indian Penal Code.

Petitioner happens to be son-in-law of the informant and admittedly, matrimonial dispute was going on between the petitioner and his wife. Moreover, the informant claims that the petitioner and other FIR named accused came at his residence and pressurized him to put his signature on compromise petition but when the informant refused to buckle, the petitioner and other

Patna High Court Cr.Misc. No.16645 of 2016 (2) dt.26-04-2016 2/2 accused badly assaulted him and the petitioner is said to have put Gamchha around the neck of the petitioner and pulled with an intent to kill him but due to timely intervention of witnesses, his life could be saved.

Submission on behalf of petitioner is that the injury, found on the neck of informant, is simple in nature and as a matter of fact, the injury report of the informant is an engineered document.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Baikunthpur P.S. Case No. 13 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate-IIIrd, Gopalganj.
