This is an application for grant of anticipatory bail in connection with Habibpur P.S. Case No. 81 of 2017 registered for the offence punishable under Sections 376, 406, 420 and 506 of the Indian Penal Code.
The allegation against the petitioner is enticing the informant with the promise that he would get her sewing centre registered and in the process it is alleged that the petitioner herein swindled a sum of Rs. 4,00,000/- from the informant of this case as also engaged in the physical relation with the informant herein. The learned counsel for the petitioner submits that the medical examination does not support the allegation of maintaining physical relation with the informant and further the
Patna High Court Cr.Misc. No.61628 of 2017 (2) dt.29-01-2018 2/2 story as propounded by the informant is absurd. It is further submitted that the petitioner has a clean antecedent. Having regard to the facts and circumstances of the case, I deem it fit and proper to admit the petitioner herein to the privilege of anticipatory bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIIth, Bhagalpur in connection with Habibpur P.S. Case No. 81 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
