The petitioner apprehends his arrest in connection with Pupri P. S. Case No. 227 of 2016 instituted under Section 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that one of the named accused persons namely Surendra Mahto was not found involved in the offence and the police has not sent up him for trial and further one of the non-FIR persons Ram Chander Mahto has also been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 25.07.2017 passed in Cr. Misc. No. 25401 of 2017 while the prayer for anticipatory bail of the husband of the deceased has been rejected and this petitioner is the younger brother of the husband and resides separately.

Patna High Court Cr.Misc. No.52868 of 2017 (2) dt.09-11-2017 2/2 As there appears specific allegation against this petitioner of committing murder by strangulation, so prayer of anticipatory bail is rejected.
