Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 8(b)/18/29 of the NDPS, registered in connection with Bhadwar P.S.Case No. 11 of 2022. As per allegation, the petitioners were found roaming at the place where crops of opium were standing on the forest land.

The learned counsel for the petitioners has submitted that the land does not belong to the petitioners. They have falsely been implicated in this case only on the basis that they were roaming near the opium crops. The petitioners are the

Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of I/C Addl. Sessions Judge-cum-Special judge, NDPS Act, Gaya in connection with Bhadwar P.S.Case No. 11 of 2022, subject to the conditions as laid down under Section 438(2) Cr. P.C.

The trial court shall verify the criminal antecedent of the petitioners and if they are found involved in any other criminal case, except the present one, it shall be at liberty to cancel their bail bonds.

Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
