JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-04-2021 The present writ petition has been filed for quashing the order dated 28.05.2020 passed by the Commandant, B.M.P.- 1, Patna, whereby and whereunder the petitioner has been retired voluntarily in view of the application submitted by him under Rule 74(1) of the Bihar Service Code.
At the outset, the learned counsel for the petitioner submits that the petitioner would be filing an appeal before the appellate authority.
The learned counsel for the State Shri Manish Kumar, GP-4 has got no objection.
Accordingly, the present writ petition stands disposed
Patna High Court CWJC No.2789 of 2021(2) dt.07-04-2021 2/2 off as not pressed, however, with liberty to the petitioner to file appropriate appeal before the appellate authority within a period of four weeks from today and in case such an appeal is filed within a period of four weeks from today, the same shall be decided on merits without the appellate authority being impeded by the issue of limitation.
