The petitioner seeks bail in connection with Sursand P.S. Case No. 56 of 2021 instituted for the offences under Sections 457 and 380 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 19.06.2021 is a person with clean antecedent, charge-sheet has been submitted in the case and has antecedent of six cases as mentioned in the supplementary affidavit and the informant alleges in the First Information Report that on 04.09.2021 when he came out of his house at 7 a.m. he saw the lock of the get of his cousin brother broken and thereafter, he came to know that cash and valuable as detailed in the First Information Report was stolen from his house in his absence.

No.58671 of 2021(2) dt.08-03-2022 2/2 Learned counsel for the petitioner submits that the First information Report was against known and the petitioner came to be implicated because of his antecedent. It is further submitted that nothing was recovered from the possession of the petitioner which could even remotely connect him with the offence.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 19.06.2021, is a person with clean antecedent, chargesheet has been submitted in the case and nothing has been recovered from the possession of the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sursand P.S. Case No. 56 of 2021, subject to condition that one of the bailor shall be the wife of the petitioner, namely, Kusum Devi. (Satyavrat Verma, J) Jagdish/- U T
