JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2015 The petitioner is languishing in custody since 03.02.2015 in connection with Bodh Gaya P.S. Case No. 37 of 2015 for the offences instituted under Sections 399, 402 of the I.P.C. and 25(1-b)1A, 26 and 35 of the Arms Act. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on confidential information received by S.I. Bodh Gaya that 5-6 unknown miscreants are sitting near the bank of Mahane river, he alongwith armed forces proceeded to the place of occurrence. Seeing the armed forces the accused persons tried to flee away that the police forces are coming. In the meantime, police forces chased the miscreants and became successful to apprehend the miscreants

Patna High Court Cr.Misc. No.24120 of 2015 (2) dt.06-07-2015 2/2 named Kamlesh Pasewan, Dinesh Kumar, Mithilesh Paswan and Kamta Paswan.

It has been submitted on behalf of the petitioner that one country made pistol and one live cartridge is said to have been recovered from possession of the petitioner. It is further submitted that the petitioner has got no criminal antecedent. It is further submitted that the petitioner is in custody since 03.02.2015. It is further submitted that the petitioner may be released on bail after completion of six months in custody.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named be released on bail after completion of six months in custody from 03.02.2015 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya, in connection with Bodh Gaya P.S. Case No. 37 of 2015.
