The petitioner apprehends his arrest in Gogri P.S. Case No. 143 of 2021, registered for the offences punishable under Sections 307, 323 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

Prosecution case in brief is that on the alleged date and time of occurrence all the FIR named accused persons including petitioner and five unknown persons came at the house of informant in drunken condition started abusing the informant and others. On protest, co-accused Pankaj Yadav assaulted with iron rod on his head causing injury to him. Petitioner assaulted Rubi Devi by means of Khanti, as a result of which she sustained injury. Patna High Court CR. MISC. No.59274 of 2021(2) dt.04-07-2022 2/2 accused persons pushed female members on the ground and also made indiscriminate firing and took Rs. 5,000/- from possession of informant.

It is submitted that there is land dispute between the parties. Both parties are Gotia. Case and counter case. Injuries have been found to be simple in nature.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Gogri P.S. Case No. 143 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
