JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 12.11.2014 in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

It is alleged against the petitioner and co accused Hiralal Mahto to have caught hold of the legs of the informant's brother whereas co accused Tapeshwar Mahto and Rajesh Mahto caught hold of the hands of the victim and other accused persons assaulted and killed the victim.

It is submitted by the learned counsel for the petitioner that similarly situated accused Rajesh who is alleged to have caught hold of the hands of the victim has been granted bail after

Patna High Court Cr.Misc. No.24128 of 2015 (2) dt.13-07-2015 2/2 going through the postmortem report which suggests that the victim sustained as many as five injuries which are bruise and abrasion and the doctor has also opined that ante-mortem injuries were not sufficient to cause death. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bettiah, West Champaran in connection with Majhaulia P.S.
