Petitioner was neither caught on the spot nor anything was recovered from his conscious possession. The name of petitioner was disclosed by co-accused, who was caught by the police on the spot. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 25.01.2016.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Saharsa P.S.Case No. 72 of 2016.
