Petitioner seeks bail in a case registered under section 307 and other allied sections of the Indian Penal Code as well as section 177, 178 of the M.V. Act and section 4 (40) of the B.M. Act. Petitioner is said to have instigated others to assault the informant and his associates while they were on official duty. Submission on behalf of the petitioner is that no specific overt-act of assault has been levelled against the petitioner and moreover, some co-accused have already been granted privilege of bail by the court below.
Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 28.3.2016. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
