The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 315, 379 and 338/34 (inadvertently written as Section 35 in the FIR) of the Indian Penal Code.

The prosecution case though got initiated on the complaint case but subsequently police case was registered after being transferred to the police under Section 156(3) of the Cr.P.C. It is alleged that the husband of the informant was working as labour under this petitioner and due to a dispute over wages, the husband of the informant was earlier

Patna High Court Cr.Misc. No.62049 of 2017 (2) dt.22-12-2017 2/3 threatened by this petitioner. On the date of occurrence i.e. 10.11.2016 when the informant came out of her house for easing out, the petitioner Ajay Singh while driving motorcycle along with Braj Kishore Rai, as a pillion rider dashed the informant in spite of the fact that they were knowing the informant is pregnant, but somehow the pregnancy did not suffer any harm. It is submitted by learned counsel for the petitioner that in the background of wage dispute, the accusation has been levelled. Earlier also, on the issue of payment of wages, the husband of the informant had assaulted the petitioner, leading to registration of Chhauradano P.S. Case No. 11 of 2017 and thereafter the present case has been lodged. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Considering the fact that the accusation has been levelled in the background of earlier case lodged by the petitioner against the husband of the informnat, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial
