2. The petitioner seeks bail, who is in custody since 22.11.2022, in connection with Ghoswari P.S. Case No. 181 of 2022, FIR dated 20.11.2022 for the offences punishable under Sections 302 and 304 of the Indian Penal Code.

3. Earlier the prayer for bail of the petitioner was rejected vide order dated 10.08.2023 passed in Cr. Misc. No. 38783 of 2023.

4. Learned counsel for the petitioner submits that the petitioner has clean antecedent and he has falsely been implicated in the present case. He further submits that the allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR.

Learned APP for the State, on the other hand, on the basis of the materials available on the record in the case diary has vehemently opposed the prayer for bail of the petitioner and submits that it has come during the investigation in paragraph nos. 18, 19 & 27 of the case diary that the petitioner was involved in the present crime in question apart from that it appears from impugned order that charge has not been framed as yet.

6. Considering the facts and circumstances of the case as well as involvement of the petitioner in the present crime in question, I am not inclined to enlarge the petitioner on bail in connection with Ghoswari P.S. Case no. 181 of 2022 pending in the Court of Judicial Magistrate, 1st Class, Barh, Patna.

7. Prayer is refused.
