The two petitioners are accused in connection with Kadwa P.S. Case No. 133 of 2021 under sections 406 and 420/34 of the Indian Penal Code.

The allegation against the two brothers is that both of them grabbed Rs. 200000/- from the innocent informant by influencing him that there are some 'Kalash' into his court-yard with gold and silver coins.

Subsequently, nothing came out from 'those Kalash' and the informant lodged this FIR and it is in this way that these petitioners came into the judicial custody.

At the outset, the learned counsel for the petitioners

Patna High Court CR. MISC. No.58637 of 2021(4) dt.20-04-2022 2/2 submits that the petitioners are ready to provide a demand draft of Rs. 200000/- in favour of the informant issued by the State Bank of India to be deposited in the Nazarat of the Civil Court, Katihar till the pendency of the trial so that the amount after disposal of the trial is handed over to the rightful owner. Taking into the aforesaid facts if the petitioners submit a demand draft of Rs. 200000/- in favour of the informant issued by the local State of Bank of India, Katihar to be deposited in the Nazarat of the Civil Court, Katihar, the learned court below shall release both the petitioners, namely, Dilip Paswan and Mithun Kumar Paswan @ Mithun Paswan on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Kadwa P.S. Case No. 133 of 2021.

With the aforesaid observation, the bail application is allowed.
