2. The petitioner seeks bail in connection with Banmakhi P.S. Case No. 96 of 2025 registered for the offence under Sections 8(c), 21(b) and 25 of the NDPS Act.

3. As per the prosecution case, the recovery is of 205 grams of Smack from the petitioner.

4. Learned senior counsel for the petitioner has submitted that the petitioner is innocent and he is in custody since 24.03.2025. He further submits that the petitioner has no criminal antecedent.

5. Considering the quantum of recovery i.e. of intermediate quantity, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, NDPS Act, Purnea/concerned Court

Patna High Court CR. MISC. No.49074 of 2025(2) dt.11-08-2025 2/2 below in connection with Banmakhi P.S. Case No. 96 of 2025, subject to the condition that both the bailors should be close relative of the petitioner.

7. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Banmakhi Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.

8. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.

9. As the petitioner claims to have clean antecedent, the Court below, before accepting the bail bonds of the petitioner is directed to verify the antecedent of the petitioner. If the petitioner is found to be involved in any other case then the bail bonds of the petitioner shall not be accepted. (Sandeep Kumar, J) Vikas/- U
