JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 18.11.2014 in a case which was initially started on the basis of complaint petition and later on, the same was converted into police case. The accusation against the petitioner is that he committed rape on the informant but submission on behalf of the petitioner is that the informant brought the above stated case with an intent to pressurize the petitioner so that he could solemnize his marriage with the informant. It is pointed out by learned counsel for the petitioner that moreover, the petitioner has already solemnized his marriage with the informant and presently, the informant is residing in the house of the petitioner.

Patna High Court Cr.Misc. No.13439 of 2015 (2) dt.18-05-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case No. 278 of 2014.
