16-06-2021 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Jakkanpur P.S. Case No. 194 of 2020, registered for the offence under Sections 356/379 of the Indian Penal Code.

As per the prosecution case, on 21.03.2020 at 6.45 PM, while the informant was standing at Mithapur Bus Stand, four persons moving in a Scorpio vehicle stopped near him and dragged him inside the vehicle, assaulted him and after snatching Rs. 20,000/- (twenty thousand) and a Vivo mobile from the informant, they threw him near 90 feet road. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case and the vehicle in question does not belong to the petitioner. No looted article has been recovered from the possession of the petitioner. It is further

Patna High Court CR. MISC. No.4180 of 2021(3) dt.16-06-2021 2/2 submitted that till date, T.I.P. has not been held. Petitioner is in custody since 29.05.2020.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts & circumstances and period of custody of petitioner, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-XVII, Patna in connection with Jakkanpur P.S. Case No. 194 of 2020, on the following conditions:

"(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the court below and shall remain physically present, as directed by the court below, and on his absence on two consecutive dates without sufficient reason, his bail-bond shall be cancelled by the court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
