In the instant petition, petitioner has prayed for regular bail arising out of Dhamdaha P.S. case No. 162 of 2020 registered for the offences under Sections 406 and 420 of Indian Penal Code. Learned sessions judge, Purnia rejected bail petition No. 495 of 2022 dated 27.07.2022. Hence, the present regular bail.

The alleged allegations leveled against the petitioner is that he is alleged to have committed breach of trust and misappropriated government money to the tune of Rs. 30,13,600/- by selling 1612 quintles of Paddy from Bardela PACS illegally in open market which was stated to have been

In the light of these facts and circumstances the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25000/- (Rupees Twenty Five Thousand) to the satisfaction of Chief Judicial Magistrate, Purnia in connection with Dhamdaha P.S. Case No. 162 of 2020 subject to the following conditions:

1. The petitioner shall co-operate in investigation and in conclusion of the trial.

2. He shall remain present on each and every date of trial till conclusion of trial.

3. He shall not try to tamper with the evidence or intimidate the witness to delay the conclusion of trial.

4. In the event of default of two consecutive dates without any valid reasons, his bail bonds is liable to be cancelled.

5. The Court below shall verify the criminal antecedent of the petitioner and in the case, at any stage, it is found that petitioner had concealed his criminal antecedent, the court below or investigating authority shall take immediate steps for cancelling bail bond of the petitioner.
