JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2015 The petitioners are languishing in custody since 12.02.2015 in connection with Basantpur P.S. Case No. 257 of 2013 for the offences instituted under Section 302/34 of the I.P.C. Heard learned counsel for the petitioners and learned counsel for the State.
The prosecution story, in brief, is that on 22.09.2013 at about 20 O'clock at night Gautam Prasad was sitting at his house and due to previous enmity the named accused persons were came with the arms and injured the father of the informant and the villagers taken the father of the informant and the villagers taken the father of the informant for hospital and in the way the father of
Patna High Court Cr.Misc. No.24108 of 2015 (2) dt.06-07-2015 2/2 the informant died.
It has been submitted on behalf of the petitioners that there is case and counter case. Counter case is annexure-2 to the present application. It is further submitted that omnibus and general allegation has been made against the petitioners. No specific injury has been attributed against them. Further it is submitted that the petitioners have got no criminal antecedent. It is further submitted that the petitioners are in custody since 12.02.2015.
On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances that the general and omnibus allegation made against the petitioners, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan, in connection with Basantpur P.S.
