Petitioners are in custody since 02.02.2016 in connection with Nauhatta P.S.Case No.123 of 2015 registered for the offence under Sections 147, 149, 341, 342, 323, 324, 307, 379 and 302 of the IPC.
As per the prosecution case, Soman Mukhiya, the son of the informant was assaulted by the petitioners and other coaccused brutally and amount of Rs.20,000/- was also snatched and during treatment Soman Mukhiya died in PMCH.
It has been submitted on behalf of the petitioners that the petitioners are in custody since 02.02.2016. Petitioners have got
Patna High Court Cr.Misc. No.16529 of 2016 (3) dt.23-05-2016 no criminal antecedent. From perusal of paras-13 and 14 of the case diary, it is evident that specific allegation of assault has been made against one Kundan Yadav. Petitioners have falsely been implicated in the present case.
On behalf of the State, it has been submitted that the petitioners are named in the FIR.
Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of CJM, Saharsa in connection with Nauhatta P.S.Case No.123 of 2015.
