JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-08-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 419, 420, 467, 468, 471, 406 of the Indian Penal Code.
As per the prosecution case, the petitioner committed cheating and forgery against the bank and got sanctioned loan of Rs. Two lakhs by depositing forged and fabricated bonds of LIC.
Learned counsel appearing for the petitioner submits that petitioner has already deposited Rs. 50,000/- on 25.03.2021 in the Uttar Bihar Gramin Bank, Mubarakpur Branch in the account No. 100578151000351 and is ready to deposit Rs. 50,000/- within one week after his release and he is also ready
Patna High Court CR. MISC. No.4287 of 2021(6) dt.23-08-2021 2/2 to deposit the remaining amount within 12 months from the date of his release. Petitioner is in custody since 17.10.2020. Learned counsel appearing for the State opposes the prayer for bail.
In view of undertaking given by the petitioner in paragraph 2 of the supplementary affidavit, the bail petition of petitioner is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran, Chapra in connection with Marhowrah PS case No.445/2019 on the condition that petitioner shall deposit Rs. 50,000/- in the bank within one week after his release and shall deposit rest of the amount within 12 months from the date of his release, failing which the court below shall be at liberty to cancel the bail bonds of the petitioner.
