2. The petitioners have prayed for bail in a case registered for the offence punishable under sections 147, 148, 149, 323, 307, 504 of the Indian Penal Code and Section 302 was further added.

3. As per allegation in the FIR, petitioners along with co-accused persons with common intention of killing assaulted the informant's son Ripu Kumar with fists, slaps, lathi, danda, bricks and stones.

4. It is submitted by learned counsel for the petitioners that petitioners have been falsely implicated in this case due to

Patna High Court CR. MISC. No.48782 of 2023(2) dt.04-08-2023 2/2 dirty village politics. General and omnibus allegation has been levelled against the petitioners. Similarly situated other accused person has already been enlarged on bail by another coordinate Bench of this Court vide order dated 01.08.2023 passed in Cr. Misc. No. 47051 of 2023. Petitioners have got no criminal antecedent and languishing in judicial custody since 16.5.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhagalpur in connection with Jagdishpur PS Case No. 593 of 2022.
