2. The petitioner seeks regular bail in connection with Salkhua P.S. Case No. 44 of 2025 for the offences registered under Sections 8/20(b)(ii)(B)/25 of the NDPS Act.
3. As per the prosecution case, there is recovery of 02.02 kg Ganja.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. No recovery has been made from the conscious possession of the petitioner rather it is from the bag. He is in custody since 04.03.2025. Charge-sheet has already been submitted in this case. There is no chance of tampering with the evidence or absconding of the petitioner. The recovery is below the
Patna High Court CR. MISC. No.51983 of 2025(2) dt.12-08-2025 2/2 commercial quantity and Section 37 of the NDPS Act will not attract in this case. Petitioner has no criminal antecedent.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.
6. Considering the submissions made on behalf of the parties and facts and circumstances of the case, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge, Saharsa in connection with Salkhua P.S. Case No. 44 of 2025.
