The petitioner is languishing in custody since 08.01.2015 in a case registered for the offences punishable under Sections 457/380 of the Indian Penal Code.

On theft of the she buffalo and baby buffalo from the animal shed of the informant the FIR was lodged against unknown. Subsequently, the buffalos were seized from the cattle shed of the petitioner.

It is submitted by learned counsel for the petitioner that the recovery was not made from the cattle shed but the recovery was made from open shed.

Case No. 349 of 2014.
