The petitioner is in judicial custody in connection with Phulparas P.S. Case No. 273 of 2021 dated 17.7.2021 for the offence registered under sections 379 of the Indian Penal Code and Section 21MM(DPR) Act, 1957, 56(2) BM CPI(MTRS) Rules Amend 21, 15 Environment Protection Act. As per FIR, the Mining Development Officer, Madhubani alleged that on 17.7.2021, the petitioner was apprehended with his Tractor which had no registration number and was carrying 100 cub ft. sand without any valid document which clearly shows that he was involved in illegal mining of sand. This led to his arrest and is in jail since 18.7.2021 (as stated in para-15 of the bail application). Counsel for the petitioner further submits that he does not have any criminal
