JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2015 The petitioner is languishing in custody since 13.06.2014 in connection with Ghoswari P.S. Case No. 43 of 2014 for the offences instituted under Sections 25(1-b)a, 26 and 35 of the Arms Act.
Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that on 13.06.2014 at 11.30 A.M., the informant got a secret information that one miscreant having country made pistol came to village Narayanpur in a Barat. The informant alongwith other police personnel came to village Narayanpur from the police station and saw a person having country made pistol. Seeing the police the said person tried to flee away but the police caught him. On search, besides one
Patna High Court Cr.Misc. No.24110 of 2015 (2) dt.06-07-2015 2/2 country made loaded pistol two live cartridges were recovered from his pocket. On interrogation, he disclosed his name as Arjun Mahto. He did not reply about recovered arms. It has been submitted on behalf of the petitioner that one country made loaded pistol and two live cartridges is said to have been recovered from possession of the petitioner. It is further submitted that the petitioner is in custody since 13.06.2014 i.e., for more than six months.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the period in custody, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Barh, Patna, in connection with Ghoswari P.S. Case No. 43 of 2014.
