The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 342, 323, 308, 504/34 of the Indian Penal Code.
As per the allegation in FIR, while the informant along with his younger brother was going, in the meantime the accused persons including petitioner came near them and started assaulting. It is further alleged that the accused also snatched cash and mobile phone from the informant.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is further submitted that there is case and counter case between the parties. Nothing
Patna High Court CR. MISC. No.49175 of 2022(3) dt.19-01-2023 2/2 incriminating article has been recovered from his conscious possession. The petitioner is languishing in judicial custody since 30.4.2022.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Tekari P.S. Case No. 263 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Gaya.
