JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Akbarnagar P.S. Case No. 06 of 2019 registered for the offences punishable under Sections 341, 323, 307, 354B, 504 and 506 of the Indian Penal Code.

As per FIR petitioner in drunken condition assaulted father of the informant, causing fracture injury on his hand and further it appears from the impugned order that later on father of informant died.

Submission of learned counsel for the petitioner is that though there is allegation of assault but there is no injury report or post mortem report available on the record, rather deceased died because he received some injuries on fall on the ground and later on he died and dead body was not sent for post mortem examination.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Bhaglpur, in connection with Akbarnagar P.S. Case No. 06 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
