The petitioner is an accused in a case registered under Sections 147, 148, 149, 307, 379, 342, 387 and 506 of the Indian Penal Code.

The allegation against the petitioner is that he used axe blow on the head of Ram Niwas, cousin of the informant, resulting head injury.

It is submitted on behalf of the petitioner that the petitioner is in custody since 20.02.2016.Charge sheet has been submitted in this case. The petitioner has got no criminal antecedent. FIR has been instituted after four days from the alleged date of occurrence. No explanation has been made by the prosecution. It is a case and counter case. Four persons have been

Patna High Court Cr.Misc. No.17074 of 2016 (3) dt.24-05-2016 2/2 injured in the petitioner's side. Injury on the persons has not been explained by the prosecution.

On behalf of the State, it is submitted that the petitioner is named in the FIR.

Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dehri, District- Rohtas in connection with Dehri (Indrapuri) P.S.Case No. 33 of 2016.
