JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 19-12-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420 and 120B of the Indian Penal Code.

The prosecution case is that the informant purchased land from co-accused Ajay Singh for consideration amount of Rs.32,40,000/-. The petitioner has signed the sale deed as a witness. Subsequently, the informant came to know that Ajay Singh executed a forged sale deed.

It is submitted by learned counsel for the petitioner that the thrust of accusation is against Ajay Singh and

Patna High Court Cr.Misc. No.61560 of 2017 (2) dt.19-12-2017 2/2 petitioner is simply a witness to the sale deed. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Patna City in connection with Gaurichak P.S. Case No. 291 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
