2.The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Gopalganj (Cyber) P.S. Case No. 32 of 2023 instituted for the offence under Sections 420, 406 of the I.P.C. and Section 66 (C) of the I.T. Act.

3. The case of the prosecution is that the informant received a call on her mobile no. 957638070 on whatsapp and on the basis of the said call, she transferred altogether 1,32,200/- as per the direction of the caller.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has

It has further been submitted that Rs. 20,000/- has been received in the account of this petitioner. It has been submitted that petitioner is a labourer and he is having no knowledge regarding this transfer. As he went to his bank he came to know that his account has been fridged due to this transfer. It has also been submitted by learned counsel for the petitioner that petitioner is ready to deposit the sum which has been received in his account.

5. Learned APP appearing for the State has vehemently opposed the prayer of bail of the petitioner.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Gopalganj (Cyber) P.S. Case No. 32 of 2023, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. subject to the condition that the petitioner shall
