The petitioner is languishing in custody since 08.04.2015 in a case registered for the offences punishable under Sections 354A, 363, 376, 379, 420, 120B, 504 of the Indian Penal Code and 3 of the Protection of Children from Sexual Offence Act, 2012.

The prosecution case is that on 23.09.2014 17 years old daughter of the informant Sabina @ Sawana Khatoon was ravished by one Mohammad. Subsequently in Panchayati it was decided that Mohammad will marry with the victim, but thereafter Mohammad left the State and offered Rs. One lakh. It is

Patna High Court Cr.Misc. No.27159 of 2015 (2) dt.31-07-2015 2/2 alleged against the petitioner that the petitioner along with Masud Alam on 09.11.2014 tried to outrage the modesty of the daughter of the informant and took away silver locket from the daughter of the informant.

It is submitted by learned counsel for the petitioner that for the occurrence of 23.09.2014 and 9.11.2014 the FIR was lodged on 07.12.2014 and investigation has already concluded.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the thrust of accusation against co-accused Mohammad, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge -cum- Special Judge, Saharsa in connection with Salkhua P.S. Case No. 252 of 2014.
