Petitioners seek regular bail in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code.
As per the prosecution case, these petitioners along with other FIR named accused persons committed the murder of daughter of informant for non fulfillment of demand of dowry by pressing her neck with rope.
Learned counsel appearing for the petitioners submits that petitioner No.1 is brother-in-law and petitioner No.2 is mother-in-law of the deceased and they are living separately
Patna High Court CR. MISC. No.58723 of 2021(2) dt.08-02-2022 2/2 from the deceased. There is no specific allegation against these petitioners and thrust of accusation is against the husband, who is in custody. Petitioners are in custody since 26.06.2021 and and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioners, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Madhuban PS case No. 193/2021.
