08-03-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Turkauliya (Raghunathpur) P.S. Case No. 624 of 2020, registered for the offence under Sections 420, 486(A), 489(B), 489(C), 489(D), 489(E)/34 of the Indian Penal Code.

As per F.I.R., 19,800 (nineteen thousand eight hundred) fake currency has been recovered from the possession of the petitioner, which was kept in blue colour school bag. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case and no such recovery has been made from possession of the petitioner. It is further submitted that no offence under Section 420 of the I.P.C. is made out against this petitioner, as there is no wrongful gain or loss and there is no such complaint. Petitioner is in custody

Patna High Court CR. MISC. No.1868 of 2021(2) dt.08-03-2021 2/2 since 04.09.2020, having no criminal antecedent. Chargesheet has already been submitted.

Considering the aforesaid facts and circumstances as well as nature of accusation, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran in connection with Turkauliya (Raghunathpur) P.S. Case No. 624 of 2020, on the following conditions:

"(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the court below and shall remain physically present, as directed by the court below, and on his absence on two consecutive dates without sufficient reason, his bail-bond shall be cancelled by the court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
