JUSTICE ARVIND SRIVASTAVA ORAL ORDER 22-12-2017 Heard learned counsels for the petitioners and the State. Petitioners apprehend arrest in connection with Bochaha P.S. Case No. 55 of 2017 registered for the offence punishable under sections 30A, 33 of the Bihar Prohibition and Excise Act and sections 272, 273, 120B of the Indian Penal Code. Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case due to dirty village politics. There was enmity between these petitioners and police for which petitioner no. 2 had earlier lodged a case vide Annexure-2. In relation to the same, petitioner no. 2 has also lodged a complaint case vide Annexure-3. Petitioners have been implicated in this case due to aforesaid enmity with the police. Even the seizure list does not bear the signature of either these

Patna High Court Cr.Misc. No.62937 of 2017(2) dt.22-12-2017 2/2 petitioners or their family members. Petitioners have no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Bochaha P.S. Case No. 55 of 2017 in connection with Special Judge, 1, Excise, Muzaffarpur subject to the conditions laid down under section 438(2) Cr.P.C.
