2. The petitioner seeks regular bail in connection with Khudwan P.S. Case No. 77 of 2023 for the offences registered under Sections 147, 148, 149, 341, 504, 506, 324, 307, 302 of the Indian Penal Code.
3. As per the prosecution case, petitioner is alleged to have assaulted the uncle of informant, Akhilesh Singh with Garasa on his head who succumbed to injury during course of treatment.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case due to land dispute between the parties. Both parties are next door neighbours and there is no allegation of repeated blow
Patna High Court CR. MISC. No.53718 of 2024(5) dt.22-11-2024 2/2 on the injured. There is case and counter case between the parties. Petitioner has three criminal antecedents. He is in judicial custody since 21.02.2024.
5. Learned counsel appearing on behalf of the State assisted with learned counsel for the informant oppose the prayer for grant of bail to the petitioner and submits that there is direct allegation against the petitioner that he caused death to the victim by blow of Garasa.
6. Considering the fact and circumstances of the case and submissions made on behalf of the parties, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of petitioner is rejected in connection with Khudwan P.S. Case No. 77 of 2023.
