1. Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel for the opposite party no. 2.
2. Learned counsel for the opposite party no. 2, at the outset, submits that he has instruction from the opposite party no. 2 to make submission that the opposite party no. 2 does not have any objection in the event if the quashing application is
Patna High Court CR. MISC. No.51749 of 2023(5) dt.18-12-2023 2/2 allowed as the parties have compromised the case. Learned counsel further submits that the petitioners are relative of the husband of the opposite party no. 2. Learned counsel for the opposite party no. 2 next submits that the case of the husband was quashed by an order dated 15.12.2023 in Cr. Misc. No. 52006 of 2023.
3. Learned counsel for the petitioners concurs with the submissions of the learned counsel appearing on behalf of the opposite party no. 2.
4. Considering the submissions made by the learned counsel appearing on behalf of the opposite party no. 2, the order dated 23.06.2022 passed by the learned Judicial Magistrate, 1st Class, Patna in Complaint Case No. 7895(C) of 2021 whereby cognizance of the offences under Sections 323, 498A, 504, 506/34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act has been taken, is hereby quashed.
