1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 8 and 20(b)(ii)(c) of the NDPS Act.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the allegation is of recovery of 213 kgs of Ganja, out of which 116 kgs of Ganja was recovered from the house of the petitioner.

4. The learned counsel for the petitioner next submits that petitioner came to be implicated in the instant case based on confessional statement of Debu Sada in police custody which does not have any evidentiary value and the house in question is a joint family property.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that huge recovery of Ganja is alleged to have taken place from the house of the petitioner and the investigation of the case is in its nascent stages.

6. Considering the submissions made by the learned APP for the State, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner.

7. Accordingly, the instant anticipatory bail application stands rejected.
