JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-01-2018 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Mithanpura PS case no. 172 of 2015 registered for the offences punishable under Sections 385, 387 of Indian Penal Code.

The allegation is that one Dani Yadav used to demand ransom from various persons by ringing them from his mobile from inside the jail. It is further alleged that the said sim card belonged to the petitioner herein.

The learned counsel for the petitioner submits that the petitioner has got no relation or connection with the said Dani Yadav, her husband lives in Delhi for his livelihood, the petitioner

Patna High Court Cr.Misc. No.56014 of 2017 (4) dt.09-01-2018 2/2 has a clean antecedent and her valid I.D. has been misplaced hence, the said Dani Yadav could have misused the same for obtaining a sim card.

Having regard to the facts and circumstances of the case, the abovenamed petitioner, in the event of her arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, East Muzaffarpur in connection with Mithanpura PS case no. 172 of 2015 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
