JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is languishing in jail custody since 19-122015 in a case registered under Sections-307, 385, 427/34 of the Indian Penal Code and 27 of the Arms Act.
It would appear from perusal of the impugned order that the petitioner was earlier granted privilege of anticipatory bail vide order dated 17-07-2014 passed by learned Sessions Judge, Bhagalpur in ABP No. 1552 of 2014 but he could not furnish bail bonds before the trial court and accordingly, he failed to avail the privilege of anticipatory bail. Moreover, petitioner surrendered before the court below on 19-12-2015 and since then, he is languishing in jail custody. The main accused appears to have
Patna High Court Cr.Misc. No.16509 of 2016 (2) dt.26-04-2016 2/2 been acquitted of the charges but even then, the learned Additional Sessions Judge-VI, Bhagalpur rejected the prayer for bail of the petitioner.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jagdishpur (Goradih) P.S. Case No. 198 of 2013 to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur.
