JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-02-2018 Heard the learned counsel for the petitioners and learned counsel for the State.

The petitioners seek anticipatory bail in connection with Pali PS case no. 45 of 2017 registered for the offences punishable under Sections 341, 323, 504, 307 and 379 of Indian Penal Code. The allegation is regarding the family members of the informant sitting in a Jeep, whereupon the owner of the said Jeep, namely, Ranjan Yadav had come there and he began to assault the children of the informant. Thereafter, the members of the both sides came at the place of occurrence and engaged in scuffle resulting in injury to both sides.

The learned counsel for the petitioners submits that the present occurrence arises out of a case and counter case and both

No.63568 of 2017 (4) dt.07-02-2018 2/2 sides have sustained injury, however, no grievous injury is said to have been inflicted and the fact is that the petitioner no.1 Vijay Yadav has received grievous injury. It has been further submitted that the petitioners do not have any criminal antecedent. Having regard to the facts and circumstances of the case, in the event of arrest or surrender before the court concerned within a period of six weeks from the date of receipt/ production of a copy of the present order, the petitioners above named are directed to be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in connection with Pali PS case no. 45 of 2017, subject to the conditions enumerated under Section 438(2) of Code of Criminal Procedure.
