Petitioner being the husband of the informant is languishing in custody since 27.10.2015 in a case registered for the offences punishable under Section 498A of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. The basis accusation is of torture for nonfulfillment of dowry demand after seven years of marriage. Learned counsel for the petitioner submits that petitioenr admits his marriage with the informant and birth of a child. The petitioenr is still ready to keep the informant as wife with child with due dignity and honour. Statement to that effect has been made in para-15 of the petition which reads as follows:- "That, in spite of aforesaid happening petitioner is still ready to keep the informant with all dignity and honour."
Patna High Court Cr.Misc. No.16786 of 2016 (2) dt.19-04-2016 Considering the present stand of the petitioner, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sri D.K. Roy, J.M., Ist Class, Katihar in connection with Azamnagar P.S. Case No. 209 of 2015.
It is expected from the petitioner to comply the undertaking given in para-15 of the petition within a period of month from his release.
