2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 406/420/504/506 of the Indian Penal Code.
3. It is alleged by the informant that co-accused Kamlesh Rai had purchased a tractor from Maha Bhawani Auto Mobile Agency, Mahua, for which he had paid Rs.51,000/- and had assured to pay the rest of the amount of Rs.6,50,000/- after sanction of loan . But subsequently he neither applied for the loan nor paid the balance amount of Rs.6,50,000/- and thus committed cheat and when informant demanded the rest of

4. It is submitted that petitioner is not named in this F.I.R. Petitioner's named has figured during course of investigation as one of the witnesses of the alleged bond papers. He submits that Kamelsh Roy who had taken tractor on loan has already been granted bail by the Court below itself. It is also the case of the petitioner that petitioner has not received any penny in the transaction. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned C . J . M., Vaishali at Hajipur in connection with Mahua P.S. case no. 237 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
