JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code.

Petitioner happens to be mother in law of the deceased and according to prosecution case, the dead body of the deceased was found in the house of the petitioner. The investigation against the petitioner has already been completed and she is languishing in jail custody since 25.03.2015 whereas several co-accused including husband of the petitioner have already been granted privilege of bail by different Benches of this Court. Moreover, none has seen the actual killing of the deceased.

No.18925 of 2016 (2) dt.04-05-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VI, Danapur in connection with Sessions Trial No. 860 of 2015 arising out of Maner P.S. Case No. 196 of 2013.
