Petitioner is in custody since 30.12.2015 in connection with Deoriya P.S.Case No.105 of 2015 registered for the offence under Sections 341 and 386/34 of the IPC and Sections 25(1b)A/26 and 35 of the Arms Act. As per the prosecution case, it is alleged therein that on 30.12.2015 at 1 P.M. work of road was going on and in the meantime one Bazaj Boxer motorcycle bearing no.BR.06E 4035 boarded with two persons came to him and they demanded Rs.one lakh as ransom and taken out country made pistol and began to move. It is also alleged by the informant that the labourers became fear and the work was stopped.
Patna High Court Cr.Misc. No.17374 of 2016 (3) dt.24-05-2016 It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.12.2015. Chargesheet has been submitted in the case. Petitioner has got no criminal antecedent. No incriminating article is said to have been recovered from the possession of the petitioner. Petitioner has been made accused due to mistake of fact.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Sri Aditya Kumar Singh, Judicial Magistrate, Ist Class, District-Muzaffarpur in connection with Deoriya P.S.Case No.105 of 2015.
