The petitioner seeks pre-arrest bail in connection with Mohania P.S.Case No. 568 of 2017 registered under Sections 354(A)(i), 457, 506 of the Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences Act. It is submitted by the learned counsel for the petitioner that the petitioner is cousin brother of the alleged victim girl and nephew of the informant and no offence as alleged ever took place rather the fact of the matter is that since there is dispute between the two families in relation to partition of land, false case has been instituted just in order to humiliate and harass the petitioner. He further contended that the petitioner is a young boy

Having regard to the nature of the offence and the submissions made above, in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge- 1st, Kaimur at Bhabua in connection with Mohania P.S.Case No. 568 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
