The petitioners apprehend their arrest in connection with Kuchaikot P.S. Case no. 158 of 2019, registered under Sections 341, 323, 324, 308 and 504/34 of the Indian Penal Code.

The accusation is that on 03.06.2013, during the course of land measurement, hot altercation took place. At that time, on the order of Laljee Manjhi, petitioner No.1 Krishna Manjhi gave Farsa blow on the head of informant. Thereafter, petitioner No.2 Nanhey Manjhi also caused injury at the nose of informant through spade. When Pramod

Patna High Court CR. MISC. No.46277 of 2019(2) dt.26-07-2019 2/2 Kumar, son of the informant, rushed to save him then Chhatu Manjhi caused injury at his left hand by means of log of bamboo. On hulla, villages reached there then all the accused fled away.

Learned counsel for the petitioners submits that, admittedly, the scuffle took place due to land dispute. Further submission is that the injuries as found on the person of informant and his son is simple in nature. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-VII, Gopalganj in connection with Kuchaikot P.S. Case No. 158 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
