The petitioner is languishing in custody since 20.08.2014 in a case registered for the offences punishable under sections 394/302/34 of the Indian Penal Code. It is alleged that in a running Morya Express train the miscreants started robbing the passengers when protest was made by one passenger Sanjay Yadav, the accused persons shot at him, when brother of informant Mithu Kumar made protest then the accused persons fired on his forehead, who also succumbed to the injuries.
It is submitted by learned counsel for the petitioner that on the basis of confession of co-accused petitioner has been roped in the present case. Neither the petitioner has been put on
Patna High Court Cr.Misc. No.25721 of 2015 (2) dt.23-07-2015 2/2 TIP nor anything has been recovered from his possession, a statement to that effect has been made in para 7 of the petition. Similarly situated co-accused Mohan Kumar has been granted bail by a co-ordinate bench of this court vide Criminal Miscellaneous No.8523 of 2015.
Considering the aforesaid fact, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Patna in connection with Mokama GRPS Case No. 24 of 2014.
